HIPAA Notice of Privacy Practices
Our commitment
Denizen respects the confidentiality of your and your family's health information. Where we handle protected health information (PHI) as defined by the Health Insurance Portability and Accountability Act of 1996 (HIPAA), we do so in accordance with HIPAA and applicable state privacy laws.
Our role
Denizen is not itself a healthcare provider. In most cases, Denizen functions as a business associate of participating home care agencies and healthcare organizations. In some cases, we may operate as a covered entity under HIPAA. In either capacity, we take our obligations seriously.
How we may use and disclose PHI
We may use and disclose PHI for the following purposes:
- Treatment. To coordinate care with home care agencies and other providers involved in your family's care.
- Payment. To process billing and payments for services delivered through our platform.
- Operations. For quality improvement, network management, credentialing, and other business operations.
- As required by law. Including public health reporting, subpoenas, and other legal obligations.
- With your authorization. For any other purpose, we will obtain your written authorization before using or disclosing PHI.
Your rights regarding PHI
Under HIPAA, you have the right to:
- Request access to and copies of the PHI we hold about you
- Request corrections to your PHI
- Receive an accounting of disclosures of your PHI
- Request restrictions on how we use and disclose your PHI
- Request to receive communications through alternative means or at alternative addresses
- Receive a copy of this notice
- Be notified in the event of a breach of unsecured PHI
Safeguards
We maintain administrative, physical, and technical safeguards designed to protect the confidentiality, integrity, and availability of PHI. These include encryption of data in transit and at rest, access controls based on business need, workforce training, business associate agreements with vendors, and periodic risk assessments.
Business associate agreements
Where required, we enter into business associate agreements (BAAs) with covered entities and other business associates. Employers, health plans, and healthcare organizations working with Denizen may request a BAA by contacting us.
Complaints
If you believe your privacy rights have been violated, you may file a complaint with us or with the U.S. Department of Health and Human Services Office for Civil Rights. We will not retaliate against you for filing a complaint.
